An appeals court decided that the Plainfield man convicted of sexually assaulting a 4-year-old girl will get a new trial due to the prosecution and trial judge insufficiently questioning her about the importance of telling the truth, according to nj.com.
David Bueso, 35, is currently serving a 15-year prison sentence for allegedly sexually assaulting the girl, who was 7-years-old at the time of the trial, on two separated occasions. The girl later recanted one of the incidents, according to nj.com.
